How do I establish my IR35 status?
This is far from simple as there are so many possible interpretations that can be put on how you work, as each assignment can differ greatly. However, there are some pointers that will help to obtain an indication of your IR35 status click here.
IR35 is a very complex subject. Some self review is useful, but it is advisable to seek advice from an expert in IR35 when reviewing your position. Please contact your Account Manager at the JMK Group UK to arrange a professional IR35 status review.



What happens if I consider that IR35 does not affect me and the tax inspector disagrees?
If the Inspector challenges your interpretation of how you work and how your tax should be assessed, you have two options. You can either accept his ruling and pay the tax that the Inspector considers you to owe, and any interest and penalties that may be imposed upon you, or, you can challenge his opinion by taking the case to court. But don't let that frighten you at this stage as the JMK Group UK can provide you with services that are totally compliant with the IR35 regulations.



What if I have more questions?



Can I use any recruitment agency?
Not necessarily, because of compliance issues and new legislation your agency has the right to tell you which service provider to use, and which products to utilise within that company. However, as the JMK Group UK are totally compliant with this legislation it should not be a problem for us to follow you from agency to agency.



Do I pay for the JMK service when I don’t work?
No, you will only be charged a single flat fee for every timesheet that is submitted. On any weeks that you do not work you will not incur a charge.



Will I still be taxed at the end of the tax year?
No, JMK remove any tax you will need to pay from each timesheet payment we will even complete your end of year tax return for you if required.



How much paperwork is involved?
All that is required from you is the registration form and the submission of your timesheet and expenses. For your conveinience your expense claims can be administered online.



Can I work internationally?
Yes, the JMK Group UK supports contractors in a number of countries. If you would like to take advantage of our services your international posting, simply call your account manager on 01895 447 800.



How much will I save?
It is likely that by using the JMK Group UK services you can increase your net earnings by up to 25% when compared to the corresponding level paid via the PAYE system.



Are there any setup or exit fees?
No. at the JMK Group UK you will only be charged one flat fee for all of the services provided by our Personal Service Company and Umbrella Company respectively.



How long does it take to process a registration?
Once you have completed our online registration (click here to go to the registration form) your account is active within 24 hours.



Will I have to invoice my recruitment agency?
No. The JMK Group UK will do this for you. In fact, we take care of all the administration associated with your limited company.



Why isn’t everybody taking advantage of these services if it is legal to pay less tax?
You can only take advantage of working through the JMK Group UK if you are a genuine contract worker. This is governed by a piece of legislation known as IR35. The JMK Group UK staff will be able to determine your employment status.



Will I have to pay any more tax at the end of the financial year?
In most cases you will not have any end of year tax liability as you are paid as an employee. However, If you are a higher rate taxpayer you may be liable to pay more tax. If this is the case then you will need to complete a self-assessment tax return for HM Revenue and Customs. Although this is your responsibility the JMK Group UK can take care of it on your behalf.



Will I still get my holiday pay?
Yes. You are entitled to 20 days holiday per annum, starting from your first day at work. You are paid holiday pay at the rate of 8.33% of your hourly rate. As your hours worked may vary from week to week your holiday pay is calculated accordingly. This is paid to you weekly and is shown as a separate entry on your Pay Advice Slip. As you receive your entitlement weekly it is important you put this money aside for any holidays you may wish to take. You will not be paid extra when you go on holiday. As an alternative, the JMK Group UK can hold your holiday pay back and pay you when you request it. Please speak to your account manager regarding this service.



Is there a charge to change agencies?
No. Just let us know the details of your new agency, the date that you start work for them and we will make contact and put in place all the necessary arrangements to get you paid as soon as possible.



What happens once i've been working at the same client site for 24 months?
When you have been at the same client's site for 24 months, or you become aware that your contracted period will extend beyond 24 months, your workplace is no longer deemed as temporary. Once you have breached the 24-month rule and you spend 40% or more of your time at the same site, you will no longer be able to claim travel between your home and that place of work.



What about my VAT, PAYE and NI liabilities?
With the JMK Group UK Umbrella Company you do not need to worry about any of these government regulations. We take care of all your VAT, PAYE and NI liabilities. PAYE and NI are deducted and paid to the Inland Revenue by us. You can relax and let us take care of all your administration.



What happens if i do not have a P45?
If you do not have a P45 we will need to send you a P46 to complete. This is sent to the Inland Revenue who will issue us with a coding notice that advises us as to which tax code to place you on. In the meantime any payments received will be processed using an emergency tax code.



What can I claim back as expenses?
You can claim any expense as long as it was made for business use. There is no limit to the amount of expenses you can claim as long as they are legitimate. Click here for expense guide information.



When will I get paid?
The JMK Group UK pay all salaries by BACS on a Friday, this takes approximately three working days to arrive into your bank account. You can have the money sent to you via CHAPS which means that you receive your money the same day; there will be a £10.00 charge for this service. Bank holidays may affect payment dates.



How long does it take to set me up?
Once we have received your completed registration form, your account will be open and ready to use within 24 hours.



Do I have online access?
Yes, once you have registered with JMK Group UK and your account has been activated you will receive confirmation of your online account details. You can manage expenses, change personal details and view your payment history all online. This service is provided to you absolutely free of charge.



Who decides what my IR35 Status is?`
Once you have completed the simple IR35 status form, you will have a guide as to whether you are caught by IR35 or not. If you disagree with the decision you can seek independent advice from a chartered Accountant who will review your contract and working conditions and then supply you with an IR35 status report.



Legislation has changed, are your services legal?
Good question, to which the answer is yes. We have made a significant investment into legal advice to make sure that the services we provide comply with all the rules and regulations that have been set by the UK government.



I do not have a National Insurance Number?
If you do not have a National Insurance Number, You must Telephone Job Seekers Direct on 0845 6060 234 and ask them for the contact details of your local Inland Revenue Office. Make an appointment to see them and they will advise you accordingly. This is a very busy service and as such your appointment could be as long as six months away. The JMK Group UK will provide you a letter of employment to take with you to the appointment.
